Description
The action was brought by The Public Trustee as executor of the estate of the late Louisa Joll and also James and Catherine McPhillips against The Kaponga Town board.
The Both parties use water from the Kaupokonui Stream for the purpose of generating power. During the dry season, the Kaponga Town board impounds water, reducing the flow in the stream so that the plaintiffs cannot generate power to their milking shed.
